Terms of Service — herPrivacy

Last updated: [DATE] Applies to: herPrivacy for Android and iOS, version 1.0 and later.

1. The agreement

These terms are between you and herPrivacy by Karao Digital, 3/1 A, 6th Cross, 1st Main, Mahadevpura, Outer Ring Road, Mahadevpura, Bengaluru - 560048, India ("we", "us"). By installing or using herPrivacy ("the app") you accept them. If you do not, do not use the app.

We have tried to write this so it can actually be read. Where a clause matters to you in practice, it says so plainly rather than hiding behind capital letters.

2. What herPrivacy is

A menstrual cycle and PCOS tracker that runs on your phone. It records what you log, estimates when your next period is likely to begin, describes patterns it finds in your own history, and can produce a summary to take to a doctor.

It is free. There are no in-app purchases, no subscriptions and no advertising.

What it is not is set out in clause 6, and that clause is the most important one here.

3. Who may use it

You must be 12 or older. herPrivacy is not intended for children under 12 and must not be used by them.

If you are between 12 and 17, the app runs in a restricted mode: everything stays on your phone and cloud backup is not offered.

4. Your account, and why you probably do not need one

The app works fully without an account. Onboarding never asks who you are.

An account is required for one feature only: encrypted cloud backup. If you enable it, you sign in with a one-time code sent to your email, and you agree to keep access to that inbox secure. Anyone who can read your email can request a sign-in code.

You may delete your account and your backups at any time from within the app.

5. Your recovery passphrase — read this before you set one

If you turn on backup, you choose a passphrase. It never leaves your device and we never receive it. It is what makes the backup unreadable to us.

If you lose it, your backup is gone. We cannot reset it, recover it, or help you guess it. There is no support path that ends in us restoring your data, because any such path would mean we could read it.

That is a deliberate trade, and it is the whole point of the feature. Write the passphrase down and keep it somewhere safe, separate from your phone.

6. Medical disclaimer — the important clause

herPrivacy is not a medical device. It does not diagnose, treat, cure or prevent any condition, and it is not a substitute for professional medical advice.

It is not a contraceptive. Do not use it, or any prediction it makes, to prevent pregnancy. Cycle predictions are estimates from your own past data and are frequently wrong — particularly for irregular cycles, which is precisely the audience this app is built for.

Explanations are general information. The explanatory text in the app is written and reviewed by qualified clinicians, but it is written for everyone, not for you. It has not been produced by anyone who knows your history, examined you, or is responsible for your care.

When the app suggests seeing a doctor, see a doctor. herPrivacy flags patterns that may be worth asking about. It cannot tell you what they mean, and a flag is not a diagnosis. Equally, the absence of a flag is not reassurance — if something worries you, seek medical advice regardless of what the app says.

In a medical emergency, contact emergency services. Do not rely on this app.

7. What we ask of you

Use the app for its purpose. Do not:

  • Reverse-engineer, decompile or tamper with it, except where law expressly permits.
  • Attempt to access other users' data, or probe, overload or disrupt our servers.
  • Use automated systems to interact with our API outside normal app use.
  • Resell, redistribute or relabel the app.

Security researchers acting in good faith are welcome. Contact karao.digital@gmail.com before testing anything against our servers, and we will not pursue you for responsible research conducted within the scope we agree.

8. Our liability

The app is provided "as is". We do not warrant that predictions will be accurate, that it will be uninterrupted, or that it is fit for any particular purpose beyond those described here.

To the extent Indian law permits, we are not liable for indirect or consequential loss, for decisions taken in reliance on a prediction, or for data lost because a recovery passphrase was forgotten.

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, for fraud, or under India's consumer-protection law.

9. Changes

We may change the app or these terms. If a change to the terms is material we will tell you in the app before it takes effect. Continuing to use herPrivacy afterwards means you accept the revised terms; if you do not, delete the app.

10. Ending it

You may stop at any time by deleting the app, which removes all local data. To remove backups from our servers, delete them in Settings → Backup, or ask the Grievance Officer.

We may suspend access if the app is being used to attack our systems or other users. For anything short of that we will contact you first.

11. Governing law and disputes

These terms are governed by the laws of India. Courts at [CITY, STATE] have exclusive jurisdiction.

Before litigation, please contact us — most problems are resolved faster that way.

12. Grievance redressal

Under the Digital Personal Data Protection Act, 2023 and the Information Technology (Intermediary Guidelines) Rules, our Grievance Officer is:

Moumita Chowdhury Chatterjee Email: cmoumita88.mc@gmail.com

Complaints are acknowledged within [N] days and resolved within [N] days. This applies to data-protection complaints and to any other grievance about the app.
